ND Supreme Court Expected to Take Fighting Sioux Case

(AP) — Attorney General Wayne Stenehjem says he believes the North Dakota Supreme Court will quickly take up the dispute over the University of North Dakota's Fighting Sioux nickname.

(AP) — Attorney General Wayne Stenehjem says he believes the North Dakota Supreme Court will quickly take up the dispute over the University of North Dakota's Fighting Sioux nickname.

The Board of Higher Education wants to stop a referendum vote on a state law that says UND has to use the nickname. Board members say the law violates the North Dakota Constitution, and Stenehjem says he agrees with them.

The constitution says disputes over ballot measures may be reviewed by the Supreme Court without having the issue go to a lower court first.

Stenehjem says the Supreme Court has been willing to invoke its original jurisdiction in high-profile cases before, and he believes the court will do it in this case.

He's hoping the court will hear arguments by mid-March.
