BISMARCK, N.D. (AP) — Secretary of State Al Jaeger is getting two attorneys to represent his office in the Fighting Sioux lawsuit.
They are Sarah Andrews Herman and Matthew Kipp of Fargo.
North Dakota's Board of Higher Education is suing Jaeger over a proposed referendum on whether the University of North Dakota's sports teams must be called the Fighting Sioux.
The board is trying to force Jaeger to keep the referendum off the June ballot. The board says the pro-nickname law is against the state constitution.
Attorney General Wayne Stenehjem would normally represent Jaeger. But Stenehjem is representing the Board of Higher Education, so Jaeger had to find other attorneys.
The North Dakota Supreme Court has been asked to hear the case right away. Jaeger's lawyers have until March 6 to file arguments.
