HALLOCK, MN - A Greenbush, MN, bus driver will avoid jail time after agreeing to a plea agreement for sexual contact he had with a 15-year-old girl who used to ride the Tri-County school bus he drove.

David John Gustafson, 66, pleaded guilty Tuesday to one count of criminal sexual conduct.

Gustafson has no prior criminal record. County attorney Roger C. Malm said the state is seeking a sentence of 10 years probation with an evaluation and counseling.

Gustafson wrote a letter to the girl that expressed love and a need for the two to conceal their feelings for each other.

He later met the girl and had sexual contact with her two different times. He was charged with second-degree criminal sexual conduct but that charge was changed when authorities found he didn't have contact with the girl while she was still a rider on the bus, meaning he was not someone with authority over her.
