Brossarts Make Court Appearance, Want Charges Dismissed

(WDAZ-TV) - Rodney Brossart appeared with his wife, Susan, and their children Abby, Jacob, Thomas and Alex in a pre-trial hearing on Monday over criminal charges related to their resistance to law enforcement officers a year ago.

Nelson County officers were responding to a complaint from a neighbor over three stray cows and their calves that wandered onto land owned by the Brossarts.

A Fargo attorney representing Rodney is working to have the felony charges against him of terrorizing and theft dismissed.

He argues Rodney's arrest last summer was cruel and unwarranted.

Judge Joel Medd said he would rule within 30 days on the motions to dismiss the charges and to move the trial because of the publicity.

All six family members remain free on bail.

Attorneys for both sides have agreed to handle the cases in joint hearings.
