BISMARCK, N.D. (AP) — A man convicted of having marijuana that he planned to sell at a home with a daycare has been sentenced to 18 months in jail.

South Central District Judge Tom Schneider on Monday sentenced Antonio Anderson to five years in prison with all but 18 months suspended. Anderson will also serve four years of probation.

The Bismarck Tribune reports (http://bit.ly/PaECU1 ) that 28-year-old Anderson pleaded guilty to possession of marijuana with intent to deliver within 1,000 feet of a school. His lawyer says Anderson had the drugs at the home when children were present. The home was an unlicensed daycare that was limited to caring for no more than five children.

The woman who ran the daycare, Carli Jo Burghart, was given a three-year deferred sentence for child neglect.
