A judge says a custody investigator must testify at the criminal trial of a Fargo surgeon accused of drugging and raping his wife.

Judge Douglas Herman says it sets a terrible precedent, but it's the conclusion his legal research led him to. Fargo attorney Michael Gjesdahl was appointed as a custody investigator in the divorce case of Doctor Jon Norberg and his wife Alonna.

Prosecutors want Gjesdahl to testify about statements Dr. Norberg allegedly made during the custody investigation, regarding the number of times he had sex with his wife, while she was on propofol. Gjesdahl says this ruling puts him in an "un-neutral role" in the custody case.
