East Grand Forks Police Officer Alex Schilke noticed a motorcyclist downtown just after bar closing early Sunday driving without eye protection.

According to Schilke’s report, he stopped Scott Fashingbauer, 25, in the 300 block of DeMers Avenue at 2:16 a.m. Sunday. State law requires motorcyclists to wear eye protection, whether glasses of some kind or a helmet visor.

Fashingbauer lives on the south end of Grand Forks.

Schilke smelled alcohol and perhaps marijuana on Fashingbauer and “patted him down,” according to the report. He says he found a pill bottle with what appeared to be Oxycodone and a small amount of marijuana.

Fashingbauer was taken into custody and remained Monday in the regional jail in Crookston. He’s expected to appear in state district court there Tuesday on charges that had not yet been filed Monday, a court official said.
