BISMARCK – A federal jury has convicted a 29-year-old man for an assault outside a Fort Yates, N.D., bar last year.
Danny DeLong of Belcout, N.D., will be sentenced for assault with a dangerous weapon.
According to a news release from the U.S. Attorney’s Office:
Danny DeLong and Melvin DeLong, 25, of Belcourt, initiated an altercation Dec. 13, 2012 with several patrons at the Diamond Z Bar before leaving.
Danny DeLong continued the altercation outside the bar while Melvin DeLong went to get his vehicle. Melvin DeLong drove over the victim twice before Danny DeLong kicked the unconscious victim in the head.
The news release provided no details about the victim. However, the victim’s injuries required medical treatment without being life threatening.
Earlier this year, Melvin DeLong pleaded guilty to two counts of assault with a dangerous weapon and a judge ordered him to serve 33 months in prison. He also must serve three years on supervised probation and pay more than $19,000 restitution.
No date has been set for Danny DeLong’s sentencing hearing.
