The Minnesota Pollution Control Agency denied the Excel Dairy farm in Thief River Falls permission to operate.
Last night the MCPA Citizens Board voted against Excel Dairy's request to reconsider a March 12th decision denying the dairy farm authorization to operate under an expired permit.
The board will not vote on a permit extension for a few more months. In the mean time the board will be looking to see if the dairy farm makes an effort to meet the permit health regulations which they so far have not. Until that decision the farm is shut down, which usually doesn't happen.
"Typically a facility if they're in compliance with their permit would be able to operate even if a permit expires until it's reissued. We just wanted it to be clear they can not operate under the expired permit until a decision one way or another is made which will happen in a few months."
Reetz says in the last couple weeks they have cleaned out basins two and three but that still does not meet the permits health requirement
