N.D. Supreme Court refuses to re-open suit of former NDSU athletic officialEllis' appeal rejected
BISMARCK, N.D. (AP) - North Dakota's Supreme Court has refused to re-open an age discrimination lawsuit filed by the former sports information director at North Dakota State University.
Judge Steven Marquart initially ruled that George Ellis was fired in July 2004 because of his age. Ellis was 59 at the time. He was awarded more than $250,000 in damages.
North Dakota's Supreme Court reversed the decision. The court ruled North Dakota's anti-discrimination law didn't apply in Ellis' case, and sent the dispute back to Marquart.
Marquart then dismissed the lawsuit. Ellis appealed, but the Supreme Court on Thursday ruled against him.
Ellis worked at NDSU for 30 years. The sports information office won more than 130 national awards during his tenure.
