BISMARCK, N.D. (AP) - North Dakota's Supreme Court says a Valley
City company is owed more than $15,000 for a ruined shipment of
frozen pizzas.
Pizza Corner Inc. sold the pizzas to a customer in Anchorage,
Alaska four years ago. Court documents say the pizzas thawed when
they were shipped to Tacoma, Wash., and the buyer refused the
shipment when it arrived in Alaska.
Pizza Corner contended the CFL Transport trucking company's
refrigeration unit didn't keep the pizzas frozen in Tacoma. Some
shipping paperwork indicated the pizzas were stored at 41 degrees.
The trucking company's lawyer argued the paperwork shouldn't
have been used as evidence because the information wasn't
confirmed. The judge who heard the case considered the shipping
information and ruled against the trucking company. The Supreme
Court affirmed the decision Tuesday.
