The North Dakota Democratic Party says U.S. House candidate Rick Berg is violating state campaign law by airing radio ads on Election Day.

FARGO, N.D. (AP) — The North Dakota Democratic Party says U.S. House candidate Rick Berg is violating state campaign law by airing radio ads on Election Day.

A Tuesday release from the party says the Republican's ads are "in clear violation of the spirit and letter of the law."

Berg, a state legislator who served as the North Dakota House's Republican majority leader for six years, faces the Democratic incumbent Earl Pomeroy in the election.

Berg's campaign spokesman Tom Nelson says he wasn't aware of any ads running on Election Day.
