Attorney General Rules On Illegal Executive Session By The Alerus Center Commission

At the Alerus Center Commission meeting Wednesday, City Attorney Howard Swanson spoke on a ruling by the Attorney General Wayne Stenehjem on their illegal executive session.

Stenehjem says that the discussion about the Alerus Center audit did not warrant an executive session and that all discussion and transcripts be released publicly.

In June the Commission went into an executive session illegally violating North Dakota's open meeting law. According to state law, they should have said in advance what the closed session was going to be about, before going behind closed doors.

"We didn't know there was going to be an executive session called. So, we worked through it and certainly we apologize on behalf of the commission for that error," said Roger Swanson, previous Executive Director of the Alerus Center.

City Attorney Howard Swanson says the Commission should inform him of any future executive sessions.
