The judge in the case says the seating of a jury of 12 plus alternates may not be complete until late next week. Fairbanks is charged with murdering Mahnomen county sheriffs deputy Christopher Dewey. Dewey was shot during a standoff in 2009 and died last August.

The accomplice in the case has been arrested again, this time for assault. 29-year old Daniel Vernier was arrested in St. Cloud for assaulting the mother of his children. Vernier was at the Fairbanks trial in Crookston on Monday just hours before being arrested.

In July 2009, he pleaded guilty to failing to render assistance for his role in the shooting of Deputy Dewey. In exchange for testifying against Fairbanks, 16 other charges were dropped.
