ND Smoking Ban in Cars with Kids is Rejected

A proposed ban on smoking in cars with passengers who are younger than 13 has been beaten in the North Dakota House.

BISMARCK, N.D. (AP) — A proposed ban on smoking in cars with passengers who are younger than 13 has been beaten in the North Dakota House.

The legislation was pushed by a group of Williston High School students. They started the project when they were seventh graders. The House voted down a similar bill two years ago.

The proposed smoking ban applied to vehicles at all times, including when they parked on private property. Violations carried a $50 fine.

Minot Rep. Dan Ruby says the legislation is an intrusion on private property rights.

Williston's two House members supported the bill. Rep. Patrick Hatlestad says it was intended to protect the health of young people.

The bill was defeated 66-28. It is HB1150.
