AG Files Motion to Dismiss 'Fighting Sioux' Nickname

Attorney General Wayne Stenehjem has filed a motion to dismiss a lawsuit filed by Spirit Lake Sioux tribal members who want UND to keep its Fighting Sioux nickname.
In the motion, Stenehjem argues that the tribal members have no standing to file suit because they were not a party to the agreement between the Board of Higher Ed and the NCAA. The lawsuit argues that the board should not make any decision on the nickname until a November 2010 deadline set out in an agreement with the NCAA.
A judge has barred the board from taking any action on the nickname issue until after a December 9th hearing.
