Peter Chwialkowski was arrested for fighting with another man outside the Ralph Engelstad Arena on October, but yesterday the State's Attorneys Office said in a news release that there is insufficient evidence to prove a charge of Aggravated Assault beyond a reasonable doubt.
Today Chwialkowski issued a statement to local media, the statement is below:
"It was unfortunate that Jason was injured that night. The support and prayers he received from his friends and family, including ours, is paying off. The media/press portrayed me as a fan that "sucker punched" a UND fan. Jason made a skewed decision that, unfortunately, resulted in him being injured. In my reaction to his initial actions, I did hit Jason Smith one time after being stuck first in the upper arms and subsequently on the left side of my head. Jim Hovey, my attorney, downcasted me from going to the media during the last 7 weeks to allow truth and facts to do justice with the State of North Dakota – which just that happened. It was a very grueling 7 weeks to sit back and watch my tarnishment. I’ve said from the beginning, I never want to see anyone hurt. I stepped between a verbal altercation in attempts to prevent a physical one. Truth and facts always, always prevail. My thanks go out to all who have supported both the Smith and Chwialkowski families through this unfortunate event."
