A Manvel man accused of killing his brother took the witness stand Monday.
45-year-old Rodney Chisholm is on trial for the murder of his brother, Donald Chisholm.
On the stand Monday, Chisholm admitted killing his brother after tying his hands, striking him with a metal pipe and strangling him.
He says Donald had short bursts of rage because of pain medication he was on. The brothers also had a dispute about land.
Rodney says his brother swung at him first.
"He's out of control and I've seen him in these rages and as far as a one on one confrontation, I don't think I could take him," Chisholm said.
Chisholm says he looked for his cell phone to call authorities but never found it.
