A Tokio, ND, man was sentenced Monday to 40 years in prison for sexual abuse and a charge of commission of a federal sex offense by a registered sex offender.
Gerard G. LoveJoy, Sr., 35, was sentenced to 30 years in federal prison for the sexual abuse charge and 10 years for the other charge and will serve both sentences consecutively.
LoveJoy also has to pay $1,156 in restitution and register as a sex offender. He'll be on a lifetime supervised release following his sentence.
U.S. Attorney Timothy Purdon said LoveJoy engaged in a sexual act with a juvenile who was sleeping on September 18, 2010, according to a written release. When the juvenile awoke, LoveJoy quickly left the room and jumped out of a window of the home. The incident occured at a home in Fort Yates, ND, on the Standing Rock Indian Reservation.
LoveJoy had traveled from the Spirit Lake Reservation to Fort Yates the day prior to the incident.
LoveJoy was previously convicted for abusive sexual contact with a minor in 1997.
The case was investigated by the FBI and Bureau of Indian Affairs. Assistant U.S. Attorneys Rick Volk and Janice Morley prosecuted the case.
