No Charges in Fatal Hankinson, ND, Shooting

The Richland County State’s Attorney’s office says it won’t file charges against a Hankinson man who allegedly killed another man after a drunken argument this spring.

HANKINSON, N.D. – The Richland County State’s Attorney’s office says it won’t file charges against a Hankinson man who allegedly killed another man after a drunken argument this spring.

Authorities said Robert Arends, 56, claimed self-defense after he shot 35-year-old Brian Eugene Smith of Hankinson in the early-morning hours of April 3.

Arends had found a vehicle parked in his driveway at around 4 a.m. Smith and the two other passengers inside had been drinking.

According to the Wahpeton Daily News, Arends asked Smith to leave his property, but Smith assaulted Arends.

Arends then shot Smith with a pistol he habitually carried when he drove to work. Smith was later pronounced at a hospital in Breckenridge, Minn.

Assistant State’s Attorney Ron McBeth confirmed today that there will be no charges against Arends.
