Juror on decision: Kirkpatrick ‘hung himself on the interview'
FARGO – The jury needed to listen to just 10 seconds of the two-hour, 48-minute police interview with Gene Kirkpatrick to convict him Thursday of conspiring to murder his son-in-law, a juror said Friday.

Fargo, ND (WDAY TV) - Cass County prosecutors say there's no reason to move the trial for Gene Kirkpatrick out of Fargo. The 64-year-old Oklahoma man is accused of hiring Michael Nakvinda to kill his former son-in-law, Philip Gattuso. Nakvinda was found guilty last month.
After nearly six hours of mulling the case against the man accused of killing his brother, jurors had unanimously agreed Michael Nakvinda was the man who had hit Philip Gattuso in the head with a hammer repeatedly on Oct. 26, 2009 – leaving him to die on his bedroom floor, skull shattered like broken glass as blood pooled under him.
Jurors began their deliberations Thursday in the trial of an Oklahoma City handyman accused of beating a Fargo dentist to death with a hammer, after attorneys spent the morning clashing over whether the mostly circumstantial evidence presented was enough to secure a conviction.
Despite exhaustive biological testing, none of the forensic evidence in the Phillip Gattuso murder can be linked to the man police accuse of the crime.

An Oklahoma man accused of hiring his handyman to murder his son-in-law in North Dakota told investigators he paid $3,000 before the killing, but never ordered it, according to a recording played Thursday for jurors in the handyman's murder trial.
Jurors in the trial of a man accused bludgeoning a Fargo dentist to death with a hammer saw photographs of the blood-splattered crime scene Wednesday and heard a recording of a police interview with the victim's father-in-law, who is charged with setting up the alleged murder-for-hire scheme.
